CONTRACT MANAGEMENT
EU AI ACT
The EU AI Act is a risk-based framework regulating AI. It bans unacceptable practices, heavily restricts high-risk applications like hiring, and requires strict transparency, safety and human oversight.
Service level agreements will need to not only include uptime availability, disaster recovery procedures and defect resolution procedures but also have clear documentation of all agents, algorithms, large language models and context protocols that are used by the software vendor and what risks can be introduced with the use of this technology.“ The decision of fault between a company, team, and vendor will be blurry and new casework will serve to provide legal precedents, but ultimately the buyer initiating the agentic procurement process must have a governance model in place with an appropriate mitigation strategy in the event AI gets it wrong in the procurement and sourcing process,” explains Shaz.
EU DATA ACT
The EU Data Act unlocks industrial and connected device data across Europe. It empowers users to access and share non-personal data, promotes cloud provider interoperability and prevents unfair, non-negotiable data contracts.
CSDDD
The Corporate Sustainability Due Diligence Directive mandates large EU and non-EU firms to prevent and mitigate negative human rights and environmental impacts throughout their global supply chains and operations.
